The Compensation Factor

Personal injury compensation claims in the UK can be made when you have suffered injuries in an accident. We at Bartletts Solicitors specialise in the area of personal injury law and obtaining compensation for people injured as a direct result of someone else’s negligence. With our client not being liable to pay our fees win or lose and getting a £300 advance when instructing us via our website pursuing a claim couldn’t be easier.

Although we cannot put you in the position you were in prior to the accident physically we can seek to recover money to compensate clients for their injuries. Compensation is based on the amount of pain, suffering and loss of amenity sustained as a result of the accident. There are now websites available to assist claimants in seeing how much their injury is worth. Guidelines are in place to assist Solicitors in accurately assessing how much a person’s injury is worth in the eyes of the law. It is not always simple and straightforward. For example a typical whiplash injury lasting 1 month can fetch a value of approximately £1,000, however, this is not to say that a 2 month injury would be worth twice as much. To give an idea of this a 1 year whiplash injury is worth a maximum of £2,750. Other injuries are very difficult to value such as scars. When placing a value on scarring we have to look at a number of factors such as the age and sex of the person scarred, where the scar is, the size of the scar and whether it is causing any pain.

It is common knowledge that compensation is claimed from insurance companies but do not think that you cannot still pursue a claim if no insurance is available. For example, if you have been involved in a hit and run accident and do not have the other vehicle’s details or the other driver has no insurance then we would pursue a claim with the Motor Insurers’ Bureau. The Motor Insurers’ Bureau was founded in the UK in 1946 as a private company limited by guarantee and is the mechanism in the UK through which compensation is found for claims against uninsured drivers, and hit and run incidents. They compensate innocent parties just as an insurance company would for injuries sustained although some items of financial loss are restricted.

If you have been a victim of criminal injuries you can also claim. In these circumstances a claim would be made with the Criminal Injuries Compensation Authority who value injuries based on their own guidelines.
