If you have been injured at work and your employer has no valid policy of insurance, be it for the vehicle, or Employers Liability Insurance (which by law they are obliged to have), that does not mean that you will not be compensated for any injury that you have suffered due to a work related accident in a motor vehicle.

All drivers are required by law to have compulsory motor insurance cover under The Road Traffic Act 1988.

The cover does not have to extend to comprehensive insurance as it is sufficient for Employers to insure against third party risks only. Generally speaking, as most employers’ vehicles tend to be less than 3 years old and are quite often leased the cover is normally comprehensive in any event.

If a fellow employee causes a work related injury to a passenger or occupant of another motor/pedestrian etc an Employer cannot exclude liability for any injuries sustained on the basis that the driver of their motor vehicle was not acting in the course of their employment. The insurance company have certain obligations under The Road Traffic Act to ensure that any injured parties are adequately compensated.

If you have suffered a work related injury as a passenger in an Employers’ motor vehicle due to your colleague’s negligence and it transpires that there was no valid policy of insurance in force at the time of the accident (either motor or Employer’s) you are still entitled to compensation.

There is a government department set up to compensate victims of uninsured and untraced driver claims called The Motor Insurers Bureau. The M.I.B. as it is commonly referred to deal with the claim in place of the insurance company in much the same way. The scheme is effectively paid for by the Insurers as they all contribute to the central fund.
