The most common injuries sustained in work related lifting accidents are to the Lumbar Spine (lower back) and the Thoracic Spine (mid-back).  These injuries normally occur as a result of the injured party lifting an object which is too heavy or awkward for one person to lift or as a result of the injured party attempting to lift the object in an unsafe manner.
 
If the injured party was forced to lift the item on their own as there was no assistance available from a colleague or was injured as a result of their employers’ failure to provide them with adequate training there may well be reasonable grounds for a claim to be made against their employer.

Bartletts recently acted for Mr Wilson who sustained a soft tissue injury to his Lumbar Spine whilst making a delivery to a customer’s home to deliver a new TV which the customer had purchased from his employer’s store. Mr Wilson’s colleague had to go home early that day as a result of sickness and no replacement cover was available for him that afternoon. Rather than cancelling the remaining deliveries for the day Mr Wilson’s employer told him to deliver the other items despite some of the heavier items requiring two people to lift the same. As a result Mr Wilson strained his back while attempting to lift the TV from the delivery van.
 
Mr Wilson required one month of work and the medical expert was of the opinion that it would be 15-18 months before Mr Wilson would make a full recovery from his injuries. Fortunately, on this occasion, Mr Wilson’s employers accepted liability relatively quickly and put forward an offer of £2,750.00 in full and final settlement of his personal injury claim. Bartletts managed to obtain an increased offer of £3,600.00 which Mr Wilson was content to accept.
