Can I Claim Against A Supermarket?

Many people are intimidated about bringing a claim against and potentially suing, large companies such as supermarket giants Tesco and Asda for example. It is presumed that they will instruct high paid lawyers to vigorously defend any cases on their behalf. However, it will not cost you anything to bring a claim should you have an accident while out shopping and it will be for us as your solicitors to fight your claim on your behalf.

All supermarkets have a duty of care to ensure people are safe whilst shopping in their supermarkets. If we can show that the supermarket has breached that duty and in turn that breach has caused you injury then your claim will be successful. For example if while shopping you slip on grapes on the floor or a spillage of any kind then we will argue that the supermarket did not have an adequate system of inspection and cleaning in place. It will then be for the supermarket to prove that they did have such a system in place.

We had a case recently where a gentleman, Mr Thomas, tripped over plastic ties which had been left on the floor outside a Sainsbury’s store. Mr Thomas sustained soft tissue injuries to his right shoulder, elbow, knee and ankle as a result. He did not attend hospital but did go and see his GP a couple of days later. We duly wrote to Sainsbury’s alleging that they had breached their duty of care and their legal representatives later admitted liability for the accident. We arranged for Mr Thomas to be seen by a medical expert in his locality who then prepared a report on his injuries. The medical expert thought that Mr Thomas should fully recover from his injuries within 12 months of the accident and recommended that he undergo physiotherapy treatment to hasten his recovery.

Mr Thomas received £4,000 in compensation which included an amount for private physiotherapy treatment. Mr Thomas did not have to attend Court and his claim settled within 6 months of him instructing Bartletts Solicitors.

Pursuing claims against large companies need not be difficult or complicated. Should you find yourself being involved in an accident while out shopping you should not hesitate to pursue a claim.
